Disability Rights Idaho would like to announce that Governor Little signed Senate Bill 1240 into law on Friday March 20, 2026. This bill is the result of a collaboration of many entities over the past seven years to update Idaho’s guardianship and conservatorship laws. This new law will become effective January 1, 2027. This new law is good for Idahoans with disabilities who are subject to guardianship. The new law requires that all those subject to guardianship receive an attorney to represent their interests. It further requires the application of the constitutional burden of proof to remove a fundamental constitutional right – clear and convincing evidence. The new law covers guardianships for all adults, those with developmental disabilities, mental illness and other impairments that affect someone’s ability to make decisions.
